ZONING BOARD OF APPEALS

 

Dalton Township Zoning Board of Appeals will hold a public hearings at 1616 E Riley Thompson, Muskegon, MI 49445 on May 22, 2023 at 6:00pm for the following requests:

  • A request by Thomas Becklin for a dimensional variance at 4950 Anderson Rd. This is a variance of 1 from the requirements of Section 4.20.1 of the Dalton Township Zoning Ordinance which states that a flag lot shall serve no more than 1 lot. If approved, this variance would permit the creation of a new parcel with an access easement through the access easement of an existing flag lot.
  • A request by Margot Sabato for five dimensional variances on parcels 61-07-019-300-0024-00 and 61-07-019-300-0024-10 which are vacant lands on Whitehall Rd. The request is as follows: (1) A variance of 1 from section 4.11 of the Dalton Township Zoning Ordinance for private driveway to serve three parcels and three principal buildings where a driveway shall serve not more than 2 parcels nor more than 2 principal buildings. (2) A variance of 8.82 ft from section 4.20.2 of the Dalton Township Zoning Ordinance to create a flag lot with an 11.18 ft wide access easement where a minimum width of 20 ft is required. (3) A variance of 6.2 ft from section 4.20.2 of the Dalton Township Zoning Ordinance to create a flag lot with a 13.8 ft wide access easement where a minimum width of 20 ft is required. (4) A variance from section 4.20.9 of the Dalton Township Zoning Ordinance to allow for two flag lot access drives to share a common boundary where no two access drives may share a common boundary. (5) A variance of 1 from Section 4.24.D.2 to allow a driveway to serve 3 lots where a private driveway shall serve no more than 2 lots. If approved, these variances would permit the creation of 3 new parcels which share a single private driveway.
  • A request by Jeff and Rachel Baker for a dimensional variance at 2771 Lakeshore Rd. This is a variance of 3 ft from Section 9.5.F of the Dalton Township Zoning Ordinance which requires a side yard setback of 6 ft. If approved, this would permit an accessory building to be constructed 6 ft from the side lot line.
  • A request by Gregg Nash for a dimensional variance at 4005 Central Rd from section 4.2.D of the Dalton Township Zoning Ordinance which does not allow a principal building to be constructed in the area behind an accessory building. If granted, the variance would permit the construction of a residential dwelling behind the existing accessory building.
  • A request by Thomas Nyman for a dimensional variance at 2677 Middle Lake Rd. This is a variance of 1 from the requirements of Section 4.20.1 of the Dalton Township Zoning Ordinance which states that a flag lot shall serve no more than 1 lot. If approved, this variance would permit the creation of a new parcel with an access easement through the access easement of an existing flag lot.
